Practice Exam #2, Q6

This is just a matter of wording, but when I read "Briefly describe the 4 reforms", I tend to answer with the possible changes being proposed for each (ex: eliminate, replace, change, etc.). I would think "Briefly describe the 4 doctrines" would better match with the provided answers.
What do you think?

  • Hmmm personally I find the verbiage fine as is ~ I think Graham was trying to be consistent with the wiki?

  • I'd tend to agree with Bastien, and I answered the exact same way he did when doing the exam, talking about the reforms proposed and not the doctrines themselves. When the question was asked in 2019S-7, they used "legal principles".

    The current wording does work as a question, but it is not this question that is answered the solution.

    In the end, it doesn't really matter, both interpretations make for good exam practice, it would just make more sense for question and answer to be more coherent

  • Yup when I reviewed it I had the answers side by side and it seemed reasonable. However, maybe taking it blind like you guys may lead to a different interpretation as the above. After all, you guys are "closer" to the actual exam material. Thoughts @graham ?

    what is this reform Prejudgment Interest? I never saw it mentioned anywhere in the wiki! isn't the 4th reform vicarious liability?
