The exam question asked for 2 issues in Pastore v Aviva, but Battle Card only talked about one (the first one: whether marked impairment in just one category in class 4 designation could be classified as CAT), but the second one regarding combining mental and physical injuries was not discussed.
Is this because the second issue has been included in Kusnierz v Economical?
