Dillon v Guardian Insurance Co

Why did Guardian refuse to settle for less than the policy limit? It sounds like they wanted to pay the full 5m limit instead of less (4m). Wouldn't paying less than the limit be a good financial outcome for them?

Did Dillon sue Guardian twice?
The first time when Guardian refused to settle. This trial also revealed jury's award amount of 7m?
And another time when Guardian refused absolute liability for amount above policy limit?

When did Guardian pay the 5m limit - before or after the jury awards 7m?

  • Probably cause the insurer feels they could settle for a lower amount in court.
    I believe he sued them once.
    He sued them when the final damages to be awarded was determined to be 78K. Guardian paid 50K after the final amount due of 78K was determined.
